EPA proposed to lower the dust-lead hazard standards from ten micrograms per square foot (µg/ft2) and 100 µg/ft2 for floors and window sills to any reportable level as analyzed by a laboratory recognized by the Agency's National Lead Laboratory Accreditation Program in accordance with a 2021 Ninth Circuit opinion.

The Department of Environmental Quality proposed to amend N.D. Admin. Code 33.1-15-24-01 to comply with recent changes to EPA rules. The amendments would update requirements in relation to dust-lead hazards standards and dust-lead post-abatement clearance levels, as part of the state’s EPA-authorized Lead-Based Paint Program. The amendments would implement EPA's amendments to the definitions of "clearance levels" and "dust-lead hazard" and the Agency's lowering of dust-lead hazard standards and dust-lead clearance levels. The Department of Environmental Quality proposed to amend La. Admin. Code tit. 33, §§2803 and 2811. The amendments would incorporate new EPA and HUD dust-lead hazard standards and dust-lead clearance levels for surface dust and windowsills in target housing and child-occupied facilities. A hearing will be held May 25, 2021. Comments are due that same date.

The Maryland Department of the Environment proposed to amend Md. Code Regs. 26.02.01. The amendments would, among other things, establish procedures for environmental investigations when a child younger than six or a pregnant woman is diagnosed with an elevated blood lead, add information to be reported by laboratories to the Department with blood lead level test results, and lower the state dust-lead level standards for post-abatement clearance and risk reduction standards to 10 and 100 micrograms per square foot for floors and window sills, respectively.
