EPA entered into a proposed consent decree under the CAA that resolves a lawsuit against the Agency concerning its non-discretionary duties to determine whether the West Central Pinal nonattainment area attained the 2006 24-hour fine particulate matter NAAQS by the attainment dates and to take final action to promulgate a federal implementation plan addressing certain deficiencies in Arizona's new source review program; the proposed consent decree would establish deadlines for the Agency to take specified actions related to the second claim.
