The Department of Environmental Quality amended Utah Admin. Code r. 307.309, Nonattainment and Maintenance Areas for PM10: Fugitive Emissions and Fugitive Dust. The rule change alters the requirement in response to EPA concerns that fugitive dust is not being appropriately controlled as required under the Exceptional Events Rule. The applicability is expanded to include nonattainment counties, and the emissions section has been revised to clarify that EPA Method 9 is used to measure opacity, among other changes.
