The Texas Commission on Environmental Quality will hold a public hearing on proposed amendments to 30 Tex. Admin. Code §§101.100 - 101.105, 101.107 - 101.109, 101.112, and 101.114 - 101.122, Failure to Attain Fee. The proposed amendments provide for restrictions for calculations of baseline amounts and fee obligations to remain consistent with volatile organic compound and nitrogen dioxide aggregation allowed for SIP compliance in EPA-approved SIP revisions. Baseline amounts and aggregation methods, once established, will remain fixed throughout the applicability of the penalty fee obligation in order to maintain consistency and transparency for reductions of actual emissions over time, and to prevent gaming.
