The Massachusetts Department of Environmental Protection adopted amendments to 310 CMR 74.00, 75.00, and 70.00, Mercury Management Act Phase 1. These regulations implement the initial programs established by the Mercury Management Act (Chapter 190 of the Acts of 2006). They ban the sale of products containing mercury in Massachusetts unless the manufacturer registers the product with the Interstate Mercury Education and Reduction Clearinghouse within 30 days of the product§s release; ban schools from buying mercury-containing products; require manufacturers to disclose mercury content of products in health care facilities; prohibit the sale of vehicles made after January 1, 2007, that contain mercury switches; require manufacturers to implement switch-recycling plans and recover 50% of the switches by December 31, 2007, and 90% by December 31, 2008; and require manufacturers of mercury-containing lamps to provide educational materials to consumers on mercury hazards and recycling. http://mass.gov/dep/service/approvals/erpregs.htm#hg.
