The Department of Environmental Protection will hold a public hearing on proposed amendments to Chapter 150, Control of Emissions from Outdoor Wood Boilers; and Chapter 160, Outdoor Wood Boiler Replacement and Buy Back Program. The amendments incorporate requirements for outdoor pellet boilers including setback from neighboring properties and minimum stack height. Outdoor pellet boilers are also subject to other requirements including nuisance conditions, visible emissions standards, and approved fuel. Chapter 160 establishes a replacement and buyback program to remove nuisance outdoor wood boilers that were installed prior to February 1, 2008. The proposed rule includes criteria for determining whether an outdoor wood boiler constitutes a nuisance condition or threat to public health or safety and is eligible for participation in the program, compensation criteria and amounts, and procedures for certification and verification of removal and possible replacement of eligible outdoor wood boilers.
