The Arizona Department of Environmental Quality proposed amendments to R18-5-105 through 109, Classification of Treatment Plants and Certification of Operators. The proposed change would give the department the authority to permanently revoke the certification for an operator of a public water system or wastewater system. Due to the potential public health and environmental risks of recertifying an operator whose prior behavior justified revocation of the operator§s certification, the department plans to remove the provision currently in rule that would allow an operator whose license was revoked to be readmitted simply by passing the exam. The proposed rulemaking would clarify that a revocation is intended to be permanent, unless otherwise provided.
