Colorado: Waste

The Department of Public Health and Environment proposed amendments to regulations governing firefighting foam containing PFAS. The amendments would, among other things, incorporate the exemption criteria created by H.B. 22-1345 for the use of PFAS aqueous film-forming foam. A hearing will be held February 20, 2024. Comments are due February 7, 2024.

Tennessee: Wildlife

The Department of Environment and Conservation proposed to update the endangered plant list by removing, adding, and correcting names that appear on the current list. A hearing will be held March 26, 2024. Comments are due March 28, 2024.

Louisiana: Natural Resources

The Department of Natural Resources adopted amendments to regulations governing termination of units. The amendments clarify when an operator of record should apply for a hearing if production is reestablished in a terminated unit, establishment of new units overlapping terminated units, and termination of units subsequent to dissolution. Colorado: Water

The Department of Public Health and Environment proposed amendments to regulations governing water and wastewater facility operators certification requirements. The amendments would remove the certified operator requirement for Category D graywater and instead specify that a certified operator is required for graywater treatment works that produce greater than 2,000 gallons per day. A hearing will be held February 27, 2024. Comments are due February 7, 2024.

Colorado: Waste

The Department of Public Health and Environment proposed amendments to regulations governing solid waste user fees. The amendment would increase the solid waste management fund’s portion of the solid waste user fee from $0.13 per cubic yard to $0.22 per cubic yard for one year beginning July 1, 2024. A hearing will be held February 20, 2024. C­­­omments are due February 7, 2024.

Colorado: Waste

The Department of Public Health and Environment proposed amendments to regulations governing composting at solid waste sites and facilities. The amendments would increase allowable Type 2 feedstock volumes for conditionally exempt small quantity facilities, permit certain Class I facilities to accept off-site food waste, implement a standard operator training requirement for Class I, II, and III facilities, and update requirements for sampling, storage, and use of finished compost and soil amendments. A hearing will be held February 20, 2024.

Colorado: Toxic Substances

The Department of Agriculture proposed amendments to regulations governing the administration and enforcement of the Pesticide Applicators’ Act. The amendments would clarify new federal certification categories under 40 C.F.R. Part 171 by differentiating the 309 Soil/Non-soil fumigation category into subcategories that address soil and non-soil fumigation applications and removing the term "agricultural" from the Aerial Pest Control category definition. A hearing will be held February 22, 2024. Comments are due the same date.
