In relation to its combined sewer overflows that resulted in the discharge of pollutants from its wastewater collection system, a settling CWA defendant must implement an approximately 20-year program of improvements that will result in the defendant eliminating or capturing for treatment 95% of its annual wet weather combined sewage.
