Missouri: Air

The Air Conservation Commission will conduct a public hearing to consider the amendment of 10 CSR 10-6.075, Maximum Achievable Control Technology Regulations. This rule establishes emission control technology, performance criteria, and work practices to achieve emission standards for sources that emit or have the potential to emit hazardous air pollutants. The commission proposes to amend subsection (1)(A). If the commission adopts this rule action, it will be submitted to U.S. EPA for delegation of enforcement authority. The hearing will be held June 26, 2008. Comments are due July 3, 2008.

Missouri: Air

The Air Conservation Commission will conduct a public hearing to consider the amendment of 10 CSR 10-6.080, Emission Standards for Hazardous Air Pollutants. This rule establishes emission standards and performance criteria for new or modified sources emitting hazardous air pollutants. The purpose of this rulemaking is to amend 10 CSR 10- 6.080 to incorporate 40 CFR part 61 subparts amended between July 1, 2005, and June 30, 2006. The hearing will be held June 26, 2008. Comments are due July 3, 2008.

Montana: Waste

The Department of Environmental Quality has added an additional public hearing and extended the deadline for comment on proposed amendments to rules pertaining to the licensing and operation of solid waste landfill facilities. New Jersey: Toxic substances

The Department of Environmental Protection seeks public comment on proposed amendments to Radiation Protection Programs' Regulations in Support of Agreement State Initiative N.J.A.C. 7:28-1 through 13, 17, 18, and 48, and proposed new N.J.A.C. 7:28-50 through 64. The proposed revisions are required to make New Jersey's regulations adequate and compatible as compared to those of the NRC. These revisions are required in support of New Jersey's effort to become an Agreement State.

New Jersey: Toxic substances

The Department of Environmental Protection will hold a public hearing to consider the readoption, with amendments, of Subchapter 16 of the UST rules, N.J.A.C 7:14B, which provides the requirements that an individual or business firm must meet in order to be certified to provide services on unregulated heating oil underground tank systems. The amendments include a new section concerning the professional business practices that a party must meet in order to be certified. The hearing will be held June 13, 2008. Comments are due July 4, 2008.

New York: Climate Change

The Department seeks public comment on proposed amendments to 6 NYCRR Part 242, CO2 Budget Trading Program, revisions to 6 NYCRR Part 200, General Provisions, and Acceptance of the Supplemental Draft Generic Environmental Impact Statement. Revised Part 242 establishes a market based program designed to cap and reduce carbon dioxide emissions from power plants by 10 percent by 2019. Certain revisions to Table 1 of 6 NYCRR 200.9, Referenced Material, are necessary to facilitate the administration of these programs and are included as part of this rulemaking package.

North Dakota: Governance

The North Dakota Department of Health will hold a public hearing to address proposed amendments to North Dakota Administrative Code Article 33-34, Specifications and Standards for Petroleum and Fuel Products. The purpose of the amendments is to update the current specifications and standards to address alternative fuels including: mixtures containing up to 85% or more by volume of alcohol fuel (E85), and mixtures of biodiesel up to 100% biodiesel (B100). The amendments also include labeling requirements for the same. The hearing will be held May 29, 2008.

Ohio: Water

The Ohio Environmental Protection Agency, Division of Drinking and Ground Waters, will hold a public hearing to address proposed revisions to a Backflow Prevention and Cross-connection Control rule of the Ohio Administrative Code, which sets forth the requirements for water service connections with booster pumps. The draft amendments are, in part, a result of the five year rule review requirements of Section 119.032 of the Revised Code. The hearing will be held June 11, 2008. Comments are due June 11, 2008.

Oklahoma: Air

The Department of Environmental Quality adopted amendments to the Chapter 100 definition sections 252:100-1-3, 252:100-8-1.1, 252:100-37-2, and 252:100-39-2 to clarify and/or remove redundant definitions from Chapter 100. Among the changes is a refined definition for volatile organic compounds including an exemption for tert-butyl acetate. These changes will clarify these terms as they are meant to be used in the chapter.
