Louisiana: Toxic substances

The Department of Environmental Quality adopted changes to LAC 33:XI.103, 301, 303, 403, 507, 509, 701, 703, and 903, Secondary Containment for UST Systems. These rule changes require owners and/or operators of UST systems to install secondary containment with new installations or replacements of tanks and/or piping, under-dispenser containment and submersible pump containment, and secondary containment for certain repairs to tanks or piping made after December 20, 2008. http://www.doa.la.gov/osr/reg/0810/0810.doc pp. 2116-2121.

Louisiana: Toxic substances

The Department of Environmental Quality proposed amendments to LAC 33:I.807, Expedited Penalties for Asbestos and Lead. This rule would make additions to the list of violations that may qualify for expedited penalties for certain asbestos and lead violations. Louisiana: Water

The Department of Environmental Quality proposed amendments to LAC 33:IX.1105, 1113, and 1123, Dissolved Oxygen Criteria for Barataria and Terrebonne Basins. The amendments would revise the dissolved oxygen criteria for 60 water quality management subsegments in the Barataria and Terrebonne Basins. The amendments would also revise Table 3 of LAC 33:IX.1123 accordingly and make minor clarifications to the narrative dissolved oxygen standard in LAC 33:IX.1113. http://www.doa.la.gov/osr/reg/0810/0810.doc pp. 2274-2279.

Maine: Waste

The Department of Environmental Protection will hold a public hearing on proposed revisions to Ch. 400, General Provisions, and Ch. 409, Processing Facilities; and creation of Ch. 410, Composting Facilities.

Mississippi: Toxic substances

The Department of Environmental Quality adopted amendments to Part 280, Technical Standards and Corrective Action Requirements for Owners and Operators of USTs. The amendments address industry codes and recommended practices for the operation and maintenance of secondary containment. The changes also include the addition of appendices providing guidelines on the operation of petroleum UST systems and the evaluation of UST cathodic protection systems.

Missouri: Air

The Department of Natural Resources proposed amendments to 10 CSR 10-6.400, Restriction of Emission of Particulate Matter From Industrial Processes, which restricts the emission of particulate matter in the source gas of an operation or activity. Missouri: Water

The Department of Natural Resources proposed amendments to 10 CSR 20-7.050, Methodology for Development of Impaired Waters List. Montana: Air

The Department of Environmental Quality will hold a public hearing on proposed amendments to ARM 17.8.308, Particulate Matter; 17.8.504, Permit Application Fees; 17.8.744, General Exclusions for Air Quality Permits; and 17.8.1205, Requirements for Timely and Complete Air Quality Operating Permit Applications. The changes will ensure that a Montana air quality permit and a Title V permit may be processed in an order that preserves the integrity of the timelines and, therefore, the validity of the final decision for each. The hearing will be held November 25, 2008.
