The Department of Environmental Protection seeks public comment on a proposal to readopt with amendments N.J.A.C. 7:31, Toxic Catastrophe Prevention Act (TCPA).

New Jersey: Land use

The Department of Environmental Protection will hold a public hearing on proposed amendments to N.J.A.C. 7:7A, Freshwater Wetlands Protection Act. The new rules will require mitigation for impacts of 0.1 acres or greater for certain general permits. In addition, for impacts of less than 0.1 acres, the Department will require mitigation unless an applicant demonstrates that impacts have been minimized and avoided.

New Jersey: Toxic substances

The Department of Environmental Protection seeks public comment on a proposal to readopt with amendments N.J.A.C. 7:1J, Processing of Damage Claims Pursuant to the Spill Compensation and Control Act. The Spill Fund rules establish procedures for claims against the Spill Fund for compensation for damages resulting from discharges of hazardous substances. The proposal to readopt the rules includes several amendments to improve the efficiency of the processing of damage claims. In addition, the Department is proposing use its Remediation Standards at N.J.A.C.

Oklahoma: Air

The Department of Environmental Quality seeks public comment on several proposed amendments to 252:100-9, Air Pollution Control. The amendments will resolve issues regarding emission standards for nitrogen oxides (NOx) from fuel-burning equipment. The changes would address emission standards for direct-fired fuel-burning equipment, fuel-burning equipment that uses more than one type of fuel, and equipment with technological limitations. The Department is also considering changes to address emissions from low-NO burners when these are operated at low heat input values.

South Dakota: Water

The Department of Environment and Natural Resources will hold a public hearing on proposed amendments to 35 SDR 46, Groundwater Quality Rules. The amendments would require secondary containment and leak monitoring for new and replacement UST systems located within 1,000 feet of an existing community water system or any potable drinking water well, require department approved training for owners and operators of regulated UST systems, and make it illegal for noncompliant UST systems to receive delivery of regulated substances. The hearing will be October 2, 2008.

Tennessee: Waste

The Department of Environment and Conservation will hold a public hearing on 1200-01-14-.03, Siting Criteria for New Commercial Hazardous Waste Facilities. Tennessee: Water

The Department of Environment and Conservation will hold two public hearings on amendments to 1200-04-06, Underground Injection Control. The proposed amendments were drafted to obtain primary enforcement authority from EPA for the Underground Injection Control Program.
