Vermont: Toxic substances

The Pesticide Control Board seeks public comment on a petition for rulemaking requesting amendments to 2 Va. Admin. Code §20-51, Regulations Governing Pesticide Applicator Certification Under Authority of Virginia Pesticide Control Act. The changes would exempt certain government employees who use FIFRA §25(b) minimum risk pesticide products from the applicator certification requirements of the Virginia Pesticide Control Act when the only intended use of those products is to prevent immediate personal harm from stinging or biting insects. Comments are due December 1, 2009.

Virginia: Toxic substances

The Department of Environmental Quality seeks public comment on proposed amendments to 9 Va. Admin. Code §25-580, Underground Storage Tanks: Technical Standards and Corrective Action Requirements. This action will amend the technical standards and corrective actions requirements for USTs to incorporate requirements of the federal Energy Policy Act of 2005. Virginia: Water

The Department of Environmental Quality seeks public comment on proposed amendments to 9 Va. Admin. Code §25-260, State Water Quality Standards Regulation. The amendments would designate Urbanna Creek from its mouth to its headwaters and all tributaries as Exceptional State Waters. Alabama: Waste

The Department of Environmental Management will hold a public hearing on proposed amendments to Ala. Admin. Code r. 335-4, Scrap Tire Program. The amendments would clarify certain provisions related to the reporting and recordkeeping requirements for scrap tire receivers, processors, and transporters. Alaska: Water

The Department of Environmental Conservation will hold a public hearing on proposed amendments to Alaska Admin. Code tit. 18, §§80.1100, 80.1103, 80.1105, 80.1109, 80.1110, 80.1910, and 80.1990. The amendments pertain to laboratory certification, laboratory inspection requirements, reporting and recordkeeping requirements for certified laboratories, fees for laboratory certification, fees for Drinking Water Program regulatory services, and definitions. Comments are due December 28, 2009.

California: Energy

The Department of Conservation will hold a series of public hearings on proposed amendments to Cal. Code Regs tit. 14, §4 . The proposed rulemaking specifies minimum standards for the inspection, testing, maintenance, and construction of all oil and gas production facilities. Delaware: Air

The Department of Natural Resources and Environmental Control will hold a public hearing on proposed amendments to Del. Code Ann. Code tit 7, §1124, Control of Volatile Organic Compounds (VOCs); §1125, Requirements for Preconstruction Review; and §1141, Limiting Emissions of VOCs from Consumer and Commercial Products. The proposed revisions regulate the VOC and nitrogen oxide content of additional products, require the use coating application equipment that provides for high transfer efficiency, and include clean-up solvent emissions in the applicability determinations.

Delaware: Air

The Department of Natural Resources and Environmental Control will hold a public hearing on proposed amendments to Del. Code Ann. Code tit 7, §1138, Emission Standards for Hazardous Air Pollutants for Source Categories. The proposed amendment will provide greater consistency between Delaware's air toxics standards for these types of operations and the recently promulgated federal standard. In addition, the amendment proposes to include more health protective requirements that currently exist in similar area source air toxics standards. The hearing will be January 5, 2010.
