Massachusetts: Air

The Department of Environmental Protection will hold a public hearing on proposed amendments of 310 CMR 7.71, Mandatory Greenhouse Gas (GHG) Emissions Reporting Regulation. The regulation requires the reporting of GHG emissions from certain sources and creation of an accurate inventory of statewide GHG emissions that will inform and improve planning, implementation, and tracking of state efforts to address climate change. These amendments address additional reporting requirements. The hearing will be held April 30, 2009.

New Jersey: Toxic substances

The Department of Environmental Protection readopted and revised rules implementing the Toxic Catastrophe Prevention Act (TCPA) program at N.J.A.C. 7:31. The goal of the TCPA program is to protect the public from catastrophic accidents that could cause death or permanent disability to citizens beyond the property boundary.

Utah: Waste

The Department of Environmental Quality seeks public comment on proposed amendments to R315, Environmental Quality, Solid and Hazardous Waste; R315-315, Special Waste Requirements; and R315-315-1, General Requirements. The changes in Rule R315-315 are proposed to correct references to asbestos-containing material, remove unnecessary requirements, clarify procedures, and allow polychlorinated biphenol (PCB) capacitors from equipment other than fluorescent lights and waste that contain less than 50 parts per million of PCBs to be disposed of in a landfill. Comments are due May 4, 2009.

Utah: Water

The Department of Environmental Quality seeks public comment on proposed amendments to R309, Environmental Quality, Drinking Water; R309-105, Administration: General Responsibilities of Public Water Systems; and R309-105-6, Construction of Public Drinking Water Facilities. These amendments clarify the specific requirements for obtaining an exception to construction standards.

Alaska: Water

The Department of Environmental Conservation adopted amendments to 18 AAC 80.00 through 18 AAC 80.1990, Regulations Dealing with Drinking Water.

California: Air

The Air Resources Board will hold a public hearing on proposed amendments to review the technical status and implementation of California§s On-Board Diagnostic System Requirements for Passenger Cars, Light-Duty Trucks, and Medium-Duty Vehicles and Engines (OBD II) and Heavy Duty Engines On-Board Diagnostic System Requirements (HD OBD) requirements.

California: Waste

The Department of Toxic Substances Control will hold a public hearing on proposed amendments to California Code of Regulations, title 22, sections 66260.10 through 66265.147, Financial Assurance Rulemaking. The intent is to ensure that the financial burden of closure and post-closure is borne by the party that caused and benefited from the hazardous waste operation and not by the people or the state. Colorado: Water

The Colorado Public Utilities Commission will hold a public hearing on proposed amendments to 4 CCR 723-5, Rules Regulating Water and Combined Water and Sewer Utilities. The amendment applies to water corporations that provide combined water and sewer service. The bill changed the definition of a public utility to include water service providers that provide a combined water and sewer service and added these combined water and sewer providers to the Commission§s jurisdiction. The hearing will be April 24, 2009.

Delaware: Air

The Department of Natural Resources and Environmental Control (DNREC) released the final version of proposed amendments to Delaware Regulation 1141, Limiting Emissions of Volatile Organic Compounds (VOC) From Consumer and Commercial Products. The proposed amendment is based on the recently developed Ozone Transport Commission model rules, which, in turn, were based on similar California rules. The amendment, once promulgated, will reduce VOC emissions in Delaware and will become part of DNREC§s plan to attain the eight-hour ground-level ozone NAAQS by 2010.

Delaware: Toxic substances

The Department of Natural Resources and Environmental Control will hold a public hearing on proposed amendments to Delaware Regulations Governing Underground Storage Tank (UST) Systems. The changes to the UST regulations would incorporate federal requirements, add clarifying language, and seek to ensure the greatest protection of human health, safety, and the environment in Delaware. The hearing will be held April 21, 2009.
