FWS initiated five-year status reviews under the ESA for two plant and three animal species, and requests the submission of scientific and commercial data that has become available since the last review of the species.

EPA seeks comment and recommendations on the National Enforcement and Compliance Initiatives for fiscal years 2024-2027 (formerly called “National Compliance Initiatives”).

EPA responded to a rulemaking petition from the Center for Biological Diversity requesting that discarded polyvinyl chloride be listed as a hazardous waste under RCRA, tentatively denying the petition and soliciting public comment on the tentative denial.

United States v. E.I. du Pont de Nemours and Co., No. 1:21-cv-00516-MJT (E.D. Tex. Jan. 6, 2023).  A proposed amendment and order to a consent decree requires settling CAA defendants to provide for use of an alternative control technology, primarily a thermal oxidizer, to reduce benzene emissions to air at certain locations within an ethylene production facility located in Orange, Texas.

EPA proposed to approve the amended "Env-Sw 2100: Management and Control of Asbestos Sites Not Operated after July 9, 1981,” effective September 1, 2018, in place of the asbestos NESHAP provisions for inactive waste disposal sites not operated after July 9, 1981, submitted by the state of New Hampshire.

SIP Proposal: Virginia (second maintenance plan for maintaining the 1997 eight-hour ozone NAAQS in the Richmond-Petersburg area).

FWS reclassified Fender’s blue butterfly from endangered to threatened under the ESA, and finalized a rule issued under §4(d) of the Act that provides for the conservation of the species.
