EPA entered into two proposed settlement agreements in In re BP America Prod. Co., Florida River Compression Facility, Appeal No. CAA 10-04 (EAB), and WildEarth Guardians v. EPA, No. 11-9527 (10th Cir.), that require Region 8 to undertake a pilot program on source determinations in the oil and gas industry for the CAA Title V operating permit program.

EPA entered into a proposed settlement agreement in American Forest & Paper Ass'n, Inc. v. EPA, No. 10-1284 (D.C. Cir.), that requires the Agency to interpret its Mandatory Reporting of Greenhouse Gases rule as it applies to the petitioner as originally proposed.
