HUD posted CPD-21-136, Departmental Policy for Addressing Radon in the Environmental Review Process, and seeks comment from interested individuals, entities, and other parties on the proposed clarification that radon, as a radioactive substance, must be considered in the environmental review of proposed HUD-assisted projects.

EPA rescinded its June 22, 2022, final action finding that Alabama failed to submit a complete infrastructure SIP revision to satisfy the good neighbor interstate transport requirements of the CAA with respect to the 2015 eight-hour ozone NAAQS.

EPA finalized disapproval of SIP submissions for 19 states regarding interstate transport, and finalized a partial approval and partial disapproval of elements of the SIP submission for two states for the 2015 eight-hour ozone NAAQS.

NMFS announced a 90-day finding on a petition to list Olympic Peninsula steelhead as a threatened or endangered distinct population segment under the ESA and to designate critical habitat concurrently with the listing, finding that the petition presented substantial scientific and commercial information indicating that it may be warranted.

EPA approved a request by Flint Hills Resources (FHR) for an alternative means of emission limitation to utilize a leak detection sensor network with a detection response framework at its Meta-Xylene and Mid-Crude process units located at FHR’s West Refinery in Corpus Christi, Texas.

EPA entered into a proposed consent decree under the CAA in Environmental Integrity Project v. Regan, No. 1:22- cv-2243 (D.D.C.), that would establish deadlines for the Agency to review and, if necessary, revise emission factors for municipal solid waste landfills in connection with allegations that EPA failed to perform its non-discretionary duty to review and revise the methods used to estimate the quantity of emissions of carbon monoxide, volatile organic compounds, and oxides of nitrogen for municipal solid waste landfills.

FWS proposed revisions to the regulations concerning the issuance of enhancement of survival and incidental take permits under the ESA to clarify the appropriate use of such permits; clarify the Service's authority to issue the permits for non-listed species without also including a listed species; simplify the requirements for enhancement of survival permits by combining safe harbor agreements and candidate conservation agreements with assurances into one agreement type; and include portions of its five-point policies for safe harbor agreements, candidate conservation agreements with assurances, and habitat conservation plans in the regulations to reduce uncertainty.

SIP Approval: New York (revisions to ozone control strategies for gasoline dispensing sites and transport vehicles).

EPA proposed to determine that the Allegheny County, Pennsylvania nonattainment area has attained the 2012 annual fine particulate matter NAAQS by the December 31, 2021, attainment date applicable to moderate nonattainment areas.
