United States v. Spectro Alloys Corp., No. 0:12-CV-00594 (D. Minn. Mar. 6, 2012). A settling CAA defendant responsible for violations at its aluminum production facility in Rosemount, Minnesota, must pay a $600,000 civil penalty; must install two fabric filters to capture and treat facility emissions; must conduct new emission performance tests; must submit revised operation, maintenance, and monitoring plan documents; and must apply for a new operating permit at its facility. 

FWS determined endangered status under the ESA for the spectaclecase and the sheepnose mussels throughout their ranges without critical habitat designation.

EPA entered into a proposed administrative settlement under CERCLA that requires six settling parties to pay $118,503 in U.S. response costs incurred at the Arkansas Waste to Energy Superfund Site in Osceola, Arkansas, and to remove the remaining 708 drums still onsite.

EPA proposed to add four hydrofluoropolyethers to the list of compounds excluded from the definition of volatile organic compounds for purposes of preparing SIPs.

SIP Proposal: Massachusetts (attainment of the 1997 eight-hour ozone NAAQS for the Eastern Massachusetts nonattainment area for the 2008-2010 and 2009-2011 monitoring periods).

SIP Withdrawal: Delaware/New Jersey/Pennsylvania (attainment of the 1997 annual fine particulate matter NAAQS for the Philadelphia nonattainment area).

SIP Approval: Rhode Island (reasonably available control technology for nitrogen oxides and VOCs).

SIP Approval: Nevada (administrative revisions).

EPA entered into a proposed consent decree in Midwest Environmental Defense Center, Inc. v. Jackson, No. 11-cv-02137-BAH (D.D.C.), that requires the Agency to respond to a petition seeking objection to a CAA Title V operating permit issued to the Georgia Pacific Consumer Products Plant in Green Bay, Wisconsin, by July 23, 2012.
