United States v. Coffeyville Resources Refining & Marketing, LLC, No. 04-cv-01064 (D. Kan. Mar. 6, 2012). A settling CAA defendant, under a second consent decree, will be granted an extension on the installation of certain air pollution controls at its oil refinery in Coffeyville, Kansas, but must implement new and upgraded pollution controls, must comply with more stringent emission limits, and must follow more aggressive leak-detection and repair practices.

United States v. FMC Corp., No. 2:11-cv-00699 (M.D. Ala. Feb. 21, 2012). A settling CERCLA defendant must pay $300,000, plus interest, in U.S. response costs incurred at the Performance Advantage Superfund site in Coosa County, Alabama, and the United States will transfer $71,000 from the U.S. Treasury Judgment Fund to the EPA Hazardous Substance Superfund.

SIP Approval: Tennessee (infrastructure requirements for the 1997 eight-hour ozone NAAQS).

EPA restructured several sections of the transportation conformity rule so that they apply to any new or revised NAAQS; the Agency also finalized several clarifications to improve implementation of the rule.
