EPA entered into a proposed settlement agreement under the CWA and the APA in Center for Biological Diversity v. EPA, No. 21-71306 (9th Cir.), which would require the Agency to take specified steps with respect to implementation of the 2021 pesticide general permit (PGP), complete ESA consultation of the 2026 PGP, and propose for public comment certain changes to its monitoring and recordkeeping provisions.

FWS withdrew the amendment for the Hawaiian hoary bat from a direct final rule revising the taxonomy of 62 wildlife and plant species under the ESA after receiving comments relating to scientific research relevant to the bat's taxonomic classification.

SIP Approval: Michigan (changes to air pollution control rules concerning emissions limitations and prohibitions for sulfur bearing compounds).

EPA announced a two-day virtual public hearing on its proposal titled, "Multi-Pollutant Emissions Standards for Model Years 2027 and Later Light-Duty and Medium-Duty Vehicles," and proposed greenhouse gas program revisions in several areas, including off-cycle and air conditioning credits, vehicle certification and compliance, new standards to control refueling emissions from incomplete medium-duty vehicles, and battery durability and warranty requirements for light-duty and medium-duty plug-in vehicles.

EPA proposed to amend NESHAPs for Coal- and Oil-Fired Electric Utility Steam Generating Units (EGUs), commonly known as the Mercury and Air Toxics Standards, including amending the surrogate standard for non-mercury metal hazardous air pollutants for existing coal-fired EGUs; the filterable particulate matter compliance demonstration requirements; the mercury standard for lignite-fired EGUs; and the definition of startup.

EPA entered into a proposed settlement agreement under the CWA and the APA in Chesapeake Bay Foundation, Inc. v. U.S. EPA , No. 1:20-cv-2529 (D.D.C.), which would require the Agency to take steps regarding its oversight and funding of Pennsylvania’s efforts under its CWA programs to reduce nutrient and sediment discharges within the state’s portion of the Bay watershed and evaluate by the end of 2026 how each Bay state fared in meeting the 2025 Goal set forward in the last Chesapeake Bay Agreement.

SIP Proposal: Texas (disapproval of revisions intended to address contingency measure requirements for the Dallas-Fort Worth and Houston-Galveston-Brazoria serious nonattainment areas for the 2008 ozone NAAQS).

The Bureau of Ocean Energy management announced the availability of new outer continental shelf official protraction diagrams and official protraction aliquot diagrams depicting geographic areas in the Gulf of Mexico, which may be used for the description of potential renewable energy and mineral lease sales in the geographic areas that the diagrams represent.

EPA made technical amendments to the Code of Federal Regulations to properly codify negative declarations submitted by California on behalf of local air agencies as SIP revisions.
