United States v. Mosaic Fertilizer, LLC (Louisiana)
Under two proposed consent decrees, a settling RCRA defendant that violated storage and disposal requirements for phosphoric and sulfuric acid waste at fertilizer production facilities in Florida and Louisiana must pay a $5 million civil penalty to the United States, $1.55 million to Louisiana, and $1.45 million to Florida; must establish a $630 million trust fund, along with financial guarantees and a $50 million letter of credit, to cover phosphygypsum stack closure at four of its operating facilities and long-term care of all of its Florida and Louisiana facilities; and must spend $2.2 million on two local environmental projects in those states.
