United States v. Diesel Performance Parts, Inc.

Under a proposed consent decree concerning offers for sale and sale of motor vehicle parts that bypass, defeat, and/or render inoperative a vehicle’s installed emission controls (“defeat devices”), a settling CAA defendant must no longer manufacture, sell, or install defeat devices; stop investing in or obtaining revenue from defeat devices; not provide technical support or honor warranty claims for defeat device products; destroy any remaining defeat devices in their possession or inventory; surrender all intellectual property associated with defeat devices to EPA; and pay a civil penalty of $320,000.
