A settling CERCLA defendant must pay EPA $5.4 million in response costs incurred and to be incurred at the Nelson Tunnel/Commodore Waste Rock Pile Superfund site near Creede, Colorado, and must pay $600,000 in response costs to the Colorado Department of Public Health and Environment.
