Settling CERCLA defendants must pay $250,000, with interest, for response costs incurred by EPA and DOJ at the Atlantic Wood Industries, Inc. Superfund site in Portsmouth, Virginia, retain $15 million in CERCLA liability and lien on its real property against that liability, concede title to Virginia to new land that was created along its waterfront as part of the remedial action, agree to an environmental covenant that will impose institutional controls on its use of the property, and perform proper operation and maintenance on its property.
