An administrative law judge (ALJ) stays the liability portion of a proceeding concerning the U.S. Department of the Navy's alleged underground storage tank (UST) violations until the Department of Justice Office of Legal Counsel (OLC) issues its opinion on the U.S. Environmental Protection Agency's (EPA's) authority to assess penalties against federal facilities for UST violations. The penalty issues in this proceeding are already stayed pending the OLC's decision.
