An administrative law judge (ALJ) holds that the U.S. Environmental Protection Agency (EPA) violated the Paperwork Reduction Act (PRA) in promulgating five Resource Conservation and Recovery Act regulations under 40 C.F.R. part 265. Therefore, the ALJ dismissed EPA's claims against a company that concerned alleged violations of the part 165 regulations. The ALJ first holds that EPA is barred from prosecuting the company for violating 40 C.F.R. §§ 265.13, 265.15, and 265.16.
