An administrative law judge (ALJ) grants the U.S. Environmental Protection Agency's (EPA's) motion to withdraw without prejudice its complaint against a facility that has filed for bankruptcy. If the bankruptcy status of the facility changes, however, EPA retains the right to refile allegations of any or all of the violations alleged in the complaint. Moreover, the original filing date would apply for any statute of limitations or similar analysis.
