An administrative law judge (ALJ) denies the U.S. Environmental Protection Agency's (EPA's) motion for a default order against an alleged generator of hazardous waste. EPA argues that a finding of default is warranted on two grounds: first, for the generator's untimely prehearing exchange filing; and second, for the generator's failure to respond to an order to show cause. The ALJ, however, holds that under the circumstances of this case, a default order is unwarranted.
