An administrative law judge (ALJ) granted, in part, EPA's motion for accelerated decision after EPA charged the corporation with nine violations to RCRA and sought a civil penalty of $258,292.50. The ALJ denied the corporation's cross motion for accelerated decision but awarded EPA with judgement on liability to six of the nine counts. However, the ALJ did deny EPA a pre-hearing assessment penalty for the violations found.
