An administrative law judge (ALJ) assesses a $1,250,000 civil penalty against an oil refining company for violating the Resource Conservation and Recovery Act (RCRA) and its implementing regulations for the management of used oil and hazardous waste found in the Michigan Administrative Code Rules 299.9813 (40 C.F.R. Part 279, Subpart F) and 299.9502(1). Most of the tanks at the company’s facility were used to store or process used oil and were "used oil aboveground tanks" and "used oil existing tanks" as those terms are defined by Michigan law.
