An administrative law judge (ALJ) denies the U.S. Environmental Protection Agency's (EPA's) motion to forward its previous order to the Environmental Appeals Board for interlocutory appeal. In the prior order, the ALJ dismissed EPA's Resource Conservation and Recovery Act (RCRA) claims against a company and held that material issues of genuine fact precluded EPA's motion for accelerated decision as to the company's alleged Clean Air Act (CAA) violations.
