An administrative law judge (ALJ) held that a manufacturer violated §3008(a) of RCRA when it failed to comply with the Minnesota rule, which states that it is unlawful to store and treat hazardous waste without a hazardous waste facility permit. The U.S. Environmental Protection Agency (EPA) sought a civil penalty in the amount of $358,678 for the RCRA violation. The ALJ assessed a civil penalty of $175,000.
