V-1 Oil Company ("V-1") appeals from an Initial Decision assessing a civil penalty of $ 25,000 for violation of 40 C.F.R. § 280.70(c). This regulation requires the permanent closure of underground storage tanks (USTs) containing petroleum and other regulated substances that have been temporarily closed for more than 12 months and do not meet certain performance standards or upgrading requirements for USTs.
