United States v. Enbridge Energy, L.P.

A settling CWA and OPA defendant must pay $62 million in civil penalties and over $5.4 million in unreimbursed federal removal costs in connection with two separate oil transmission pipeline failures -- one near Marshall, Michigan, and one near Romeoville, Illinois -- that resulted in discharges of oil to waters of the United States; the proposed consent decree also includes an extensive program of injunctive relief aimed at reducing the potential for future pipeline failures and improving leak detection and emergency response and preparedness capabilities.
