Settling CWA defendants that violated NPDES permits by discharging pollutants from the Bailey Mine Complex in Greene and Washington counties, Pennsylvania, into state and U.S. waters must pay a $3 million civil penalty in three installments, perform injunctive relief to prevent contaminated discharges, conduct long-term monitoring to ensure sufficient storage capacity to prevent future discharges, develop contingency plans should future discharges become likely, and implement an environmental management system to ensure compliance with the CWA and other applicable environmental laws.
