An administrative law judge (ALJ) denies a state department of transportation's motion to reopen a U.S. Environmental Protection Agency (EPA) consent order that requires the department to pay civil penalties for a series of Resource Conservation and Recovery Act violations at an airport. The department sought to amend the consent order by adding a provision requiring it to perform a supplemental environmental project that would offset part or all of the civil penalties agreed to in the consent order. The ALJ first holds that it no longer has jurisdiction over the proceeding.
