The North Dakota Industrial Commission proposed to amend N.D. Admin. Code 43-02-02 and adopt 43-03-07.1 and 43-02-13, concerning in situ leach uranium mining, deep geothermal energy production, and high-level radioactive waste. The amendments and adoptions would, among other things, ensure that facility permits are reviewed at least once every five years, add an annual operating fee to cover monitoring and inspection costs, and specify when a radiological monitoring plan must be developed. A hearing will be held July 7, 2020. Comments are due July 17, 2020.

The Department of Environmental Quality proposed amendments to Chapter 18, In Situ Mining. The proposed amendments would update requirements for the permitting, operation, and abandonment of Class III underground injection and recovery wells associated with in situ mining of coal to meet current practices with the in situ mining industry, and update regulatory requirements to be consistent with other applicable state and federal regulations. A hearing will be held September 25, 2018. Comments are due September 21, 2018. See https://rules.wyo.gov.
