The New Mexico Environment Department proposed to adopt an air quality control regulation to be codified at N.M. Code R. §20.2.23. The proposed adoption would require mitigation plans for sources of fugitive dust that are not required to obtain a construction permit, and would apply to any area of the state that experiences recurring high-wind dust events where particulate matter NAAQS is exceeded. A hearing will be held September 28, 2018, and comments are due that same date. See http://164.64.110.239/nmregister/xxix/xxix12/EIB_AIRnotice_English.htm.
