National Wildlife Federation v. Coleman

No. 75-3256 (5th Cir. June 11, 1976)

The court denies defendants' petition for rehearing. The petition had requested the court to modify its earlier grant of injunctive relief, under the Endangered Species Act of 1973, against an interstate highway project until changes are made which enable the Secretary of the Interior to conclude that the project will not jeopardize the Mississippi Sandhill Crane. For the court's earlier opinion, see 529 F.2d 359, 6 ELR 20344. Counsel are listed at 6 ELR 20344.

Thornberry, Simpson & Morgan, JJ.

[6 ELR 20648]
