A district court dismissed a lawsuit brought by Catholic nuns seeking monetary damages for property taken by the Atlantic Sunrise natural gas pipeline. The nuns argued that construction and operation of the pipeline through land they owned would violate their free exercise of religion protected by the Religious Freedom Restoration Act (RFRA). The court found that allowing a suit for monetary damages under RFRA in addition to the just compensation they received in a previous condemnation action was inconsistent with the process Congress enacted in passing the Natural Gas Act. Because the nuns' RFRA claim was a collateral attack, the court dismissed the suit.
