Federal Trade Commission v. Peabody Energy Corp.

ELR Citation: 50 ELR 20237
Nos. 4:20-cv-00317-SEP, (E.D. Mo., 10/05/2020) (Pitlyk, J.)

A district court granted the Federal Trade Commission's (FTC's) motion to preliminarily enjoin a proposed joint venture between the United States' two largest coal producers. The Commission challenged the joint venture on antitrust grounds, arguing that it violated §7 of the Clayton Act and §5 of the FTC Act. The court found the FTC showed there was a reasonable probability that the joint venture would harm competition in the market for Southern Powder River Basin coal and that the equities weighed in favor of injunctive relief. It therefore granted the FTC's motion for preliminary injunction.
