Natural Resources Defense Council v. Zinke

ELR Citation: 50 ELR 20225
Nos. 18-cv-6903 (AJN), (S.D.N.Y., 09/28/2020) (Nathan, J.)

A district court dismissed for lack of subject matter jurisdiction a lawsuit concerning an advisory committee on hunting chartered by DOI under the Federal Advisory Committee Act. Nonprofit groups argued that the Department failed to properly charter the committee, failed to balance its membership to represent divergent views, and failed to disclose records. DOI moved to dismiss, arguing the case was moot because the committee's charter lapsed and thus ended any lingering case or controversy. The court found the groups' claims were moot because there was no further relief for the court to order now that the committee was defunct, and therefore granted DOI's motion to dismiss.
