Sierra Club v. United States Army Corps of Engineers

A district court denied a motion to preliminarily enjoin further construction of a 429-mile natural gas pipeline in Texas. An environmental group sought to halt work on the pipeline at 129 water crossings, arguing the Army Corps of Engineers authorized construction at those crossings in violation of NEPA. The court found that while the group's allegations came close to showing irreparable harm and that the group had marshaled a great deal of evidence demonstrating harm to the environment, it failed to establish a definitive threat of future harm. The court therefore denied the group's motion for preliminary injunction.
