King and Gardiner Farms, LLC v. Kern, County of

In a partially published opinion, a state appellate court set aside Kern County's approval of an ordinance amendment proposed by oil and gas industry groups to streamline the permitting process for new oil and gas wells. Environmental groups, community groups, and a local farm argued that the environmental impact report (EIR) on which the county relied to approve the ordinance violated the California Environmental Quality Act. The court found that the EIR failed to properly address the ordinance's impacts to water supplies, agricultural land, and noise, and thus that the county's approval of the ordinance and certification of the EIR must be set aside. It therefore reversed and remanded for further proceedings.
