Western Watersheds Project v. Schneider

A district court denied a motion to dismiss or transfer a lawsuit concerning greater sage-grouse habitat management plans. Environmental groups argued that BLM violated NEPA, FLPMA, and the National Forest Management Act when it issued amendments to the plans that failed to take a range-wide analysis, failed to evaluate climate change impacts, and erred in removing protections for the sage-grouse. BLM requested that the case be dismissed, or alternatively, be transferred for improper venue. The court found that the suit did not involve real property, and thus that venue was proper because one of the groups was incorporated and headquartered in Idaho. It therefore denied BLM's motion.
