Trump v. Sierra Club

The U.S. Supreme Court granted the Trump Administration's request to stay a district court order enjoining the use of military funds to build portions of a border wall along the Mexican border. The Court found that the government made a sufficient showing that nonprofit groups who filed suit had no cause of action for review of the Administration's decision to transfer $2.5 billion from DOD accounts toward construction of the wall. It therefore stayed the injunction until the Court either declines to hear the case or rules on its merits. Breyer, J., filed an opinion concurring in part and dissenting in part from the grant of stay. Ginsburg, Sotomayor, and Kagan, JJ., voted to deny the application for stay.
