Wildearth Guardians v. Conner

ELR Citation: 49 ELR 20065
Nos. 17-1334, (10th Cir., 04/15/2019)

The Tenth Circuit affirmed a district court ruling that upheld the U.S. Forest Service's management plan to protect the San Isabel and White River National Forests from insects, disease, and fire, improve wildlife habitat, and maintain watershed conditions. A conservation group argued that the Forest Service violated NEPA by failing in its EA to adequately assess the project's effects on the threatened Canada lynx, and by failing to prepare an EIS. But the court disagreed, finding that the agency reasonably concluded in its EA that the lynx would not be adversely affected under a worst-case scenario, and reasonably concluded that an EIS was not necessary. It therefore affirmed the district court ruling.
