Wildearth Guardians v. United States Forest Service

ELR Citation: 48 ELR 20169
Nos. 14-828 MV/KK, (D.N.M., 09/26/2018) (Vazquez, J.)

A district court remanded the U.S. Forest Service's decision concerning the management of roads and trails in the Santa Fe National Forest. An environmental group argued that the agency should have considered the effects of forest management on the endangered Jemez Mountains salamander. The magistrate court recommended that the group's request be granted. Before the district court, the agency argued it was not obligated to consult about the effects of its decision on the species. But the court found the agency's objections unfounded and adopted the magistrate court's recommendation. The district court therefore remanded to the agency for immediate reinitiation of consultation on the effects of its management decision on the Jemez Mountains salamander.
