Aji P. v. Washington

ELR Citation: 48 ELR 20145
Nos. 18-2-04448-1 SEA, (Wash. Super. Ct., 08/14/2018) (Scott)

A Washington state court dismissed a lawsuit filed by young Washingtonians alleging a right to a clean environment and stable climate. Specifically, plaintiffs argued that the state should be required to submit a greenhouse gas emissions reduction plan because they have a state constitutional right to a healthful environment and stable climate system. But the court found no such right within Washington's constitution, and concluded that the plaintiffs' claims present political questions that must be resolved by the political branches of government. The court therefore dismissed the suit.
