Utility Workers Union of America Local 464 & Robert Clark v. Federal Energy Regulatory Commission

ELR Citation: 48 ELR 20130
Nos. 16-1068, (D.C. Cir., 07/24/2018)

The D.C. Circuit dismissed electricity customers' petitions to review FERC's orders approving high clearing prices for future capacity to generate electricity in wholesale auctions. The customers argued that FERC's determination violated the Federal Power Act and was unsupported by substantial evidence or reasoned decisionmaking. But the court found that the customers failed to establish standing to challenge FERC's orders, and it dismissed their petitions for review.
